Upon full payment, you will own the website and its content. However, Mac Sites retains the right to use the website as part of our portfolio for marketing purposes unless otherwise agreed in writing. Pre-existing intellectual property, including but not limited to code libraries, frameworks, and design templates used in the creation of your website, remain the property of their respective owners.

5. Revisions and Changes

We include a reasonable number of revision rounds during the design phase at no additional cost. Once the website is approved and paid for, any additional changes or updates may incur additional fees unless covered under a maintenance agreement. Major redesigns or feature additions will be quoted separately.

6. Project Timeline

While we strive to complete projects within the estimated timeframe, delays may occur due to factors including but not limited to late content delivery, extended approval processes, or technical complications. Mac Sites is not liable for delays caused by circumstances beyond our reasonable control.

7. Hosting and Domain Services

If Mac Sites provides hosting services, we will make reasonable efforts to ensure your website remains accessible 24/7. However, we cannot guarantee uninterrupted service due to factors such as server maintenance, updates, or circumstances beyond our control. Domain registration and renewal are the responsibility of the client unless specifically included in the service agreement.

8. Maintenance and Support

If you have opted for a maintenance plan, we will provide ongoing support as specified in your agreement. This typically includes security updates, bug fixes, and minor content updates. Major feature additions or redesigns are not included in standard maintenance plans.

9. Limitation of Liability

Mac Sites will not be liable for any indirect, incidental, special, or consequential damages arising from the use or inability to use our services. Our total liability shall not exceed the amount paid for the specific service in question. We make no warranties regarding the operation, functionality, or security of third-party services or platforms integrated with your website.

Either party may terminate the agreement at any time with written notice. If you choose to terminate before project completion, you are not obligated to make any payment unless otherwise agreed. If Mac Sites terminates the agreement, any payments made will be refunded on a pro-rata basis for work not completed.

11. Confidentiality

Both parties agree to keep confidential any proprietary or sensitive information shared during the course of the project. This obligation continues even after the project is completed or the agreement is terminated.

12. Third-Party Services

Your website may integrate third-party services such as payment processors, analytics tools, or social media platforms. These services are governed by their own terms and conditions, and Mac Sites is not responsible for their operation, security, or policies.

13. Warranties and Guarantees

We guarantee that all websites will be built using industry-standard practices and will be responsive across devices. However, we do not guarantee specific search engine rankings, traffic levels, or business outcomes. Your website's success depends on many factors beyond our control.

14. Governing Law

These terms and conditions are governed by the laws of Victoria, Australia. Any disputes arising from these terms or our services will be subject to the exclusive jurisdiction of the courts of Victoria, Australia.
